A Californian federal judge ruled this week that Happy Birthday to You does not belong into the corporation that has long claimed it. The ruling brings to en end an intense two-year legal standoff between a handful of independent filmmakers and massive company Warner Music. It also throws into doubt as much as $ 50 million in licensing fees collected by the music giant over the past 27 years, raising the possibility of a class-action lawsuit to come.
"Happy Birthday is finally free after 80 years," Randall Newman, an attorney for the plaintiffs, told the Los Angeles Times. "Finally, the charade is over. It’s unbelievable." - THE WASHINGTON POST, reprinted in The Miami Herald, Thursday, 24 September 2015, p. 11A
The purpose of this arrangement was to show how the rhythm of the song fit to Beethoven’s melodies of the Second Movement Andante con moto of his Fifth Symphony, op. 67 of 1801, that appear from measure 22-38 and 147-150, and how it could be easily sung to these tunes.
